Shipping methods for Canadian Customers

• Canada Ground Shipping

• Arrives within 4-6 business days, and perhaps even earlier depending on your location

• Shipping cost starts at $19.00(CDN)

• On the vast majority of the orders that are placed sum totalling under $800.00(CDN) will not be subject to duty & taxes (i.e. it will arrive duty and tax free); however, this may not always be the case (subject to geographical location). Our broker will usually take responsibility and claim all duties and taxes that are applied to your shipment.

• Shipping charges will vary depending on the quantity of items you have purchased. The total shipping costs are calculated with your products in your cart page in the “shipping and total calculator” section (which allows you to see you balance and shipping costs before checking out), and even at the checkout page.

Shipping methods for International Customers

Worldwide

• Arrives within 8-21 business days depending on the shipping method you chose during check out

• Shipping costs vary according to your location. (Subject to change) Note: You can check for accurate shipping quotes through our Shipping Calculator Feature on our website.  (https://www.myscents.ca/shipping-information/)

• Shipping charges will vary depending on the quantity of items you have purchased. The total shipping costs are calculated with your products in your cart page in the “shipping and total calculator” section (which allows you to see you balance and shipping costs before checking out), and even at the check-out page

• Customs: Please note that when it comes to domestic and national customs, clearance policies vary from country to country, and so may affect overall delivery time. It is the responsibility of the customer to know the local customs policies, as there will be no refund issued on items held in customs. With that said, the majority of small orders arrive duty free; however, any additional charges for customs must be paid by you, the customer. Unfortunately we have no control over these additional charges. And this is why we urge that you are familiar with your country’s policies.  

Return Policy

Canadian Customers

• In the event that you should require a refund for an unused, unopened product, please do not hesitate to contact us for a shipping-return label. All orders can be issued a return label with proper tracking information, so long as the product is returned within 30 days after the shipping date. A full refund will be issued, unless there are other charges incurred in the process, such as shipping, duties, and gift-wraps (i.e. only in the event that these charges are applied).

• Once your refund has been issued and the item has been received at the warehouse, your refund will be processed within one billing cycle from the item is marked as received.

• If shipping was free for your order the cost of shipping the package back to our warehouse will be deducted from the credit we apply to your credit card. Please note returns coming inbound outside of U.S.A. may be subjected to import duties and taxes at the customer’s cost. Unfortunately we have no control over import duties and tax charges.

USA Customers

• All U.S.A. customers have the benefit of FREE returns, so long as the return is within the USA. If you are unsatisfied, or, for some other reason, need to return the unopened package, please contact us for a Pre-authorized Return Label, in addition to instructions on how to return the parcel.

• All orders must be returned within 30 days after the shipment date, and must be in their original package, still sealed (i.e. unopened). Open and used products will not be accepted for return. You will receive a full refund of your purchases minus shipping, duties, and gift-wrapping if it was applied.

International Returns

• Note: In the event that there are any duties and taxes are applied to the package that is being returned from outside of USA, the customer will be responsible for any additional charges that may incur, as mentioned above (section 2.3.1.4.). These charges will be applied to the credit card used to process your transaction. In the unlikely event that these charges exceed the amount the package is worth, we will charge your credit card for the remaining balance, but not without your consent first, of course!

International Customers

• Please do not hesitate to contact us by phone or email. Once we process the details of the return, we will provide you with a return shipping label and instructions on how to return your parcel. Any additional charges that may incur in the process, such as extraneous shipping charges and duties/taxes will be responsibility of the customer.

• For refunds that have been accepted and processed, you can expect a refund to your method of payment within one billing cycle of our receiving your returned product – this means that the product must be delivered to us and in-hand before we will issue process your refund. The shipping cost is non-refundable for undelivered, returned, refused, and unclaimed packages; and this is why we urge caution (please see section 2.3.1.4)

• Important Note: The customer must pay for all refund-shipping charges, and this is non-negotiable. In the event that shipping was free for your order, the balance will be deducted from the credit we had applied to the credit card used during the transaction. Please note that we are unable to accept products that are opened, damaged or used. Product must be in the exact same condition as it was sent out; otherwise the refund will not be issued.

Note: We do not refund shipping costs for refused packages, unclaimed, and undelivered packages.

Our service team will contact you by email within the next 24 to 48 hours with your return label instructions. Which is printable and can be used to successfully return your parcel.

Modification of Terms of Service

We may revise the Terms of Service from time-to-time.  Revised Terms of Service will apply to the use of our Website and the Services from the date of the publication of the revised Terms of Service on our website.  Please check this page regularly to ensure you are familiar with the current version.

Assignment

We may transfer, sub-contract or otherwise deal with our rights and/or obligations under these Terms of Service without notifying you or obtaining your consent. You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these Terms of Service.  

Severability

If a provision of these Terms of Service is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect.  If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

Entire agreement

These Terms of Service, together with our Privacy Policy constitute the entire agreement between you and us in relation to your use of the Website and the Services, and supersede any previous agreements in respect of your use of the Website and Services.

Law and jurisdiction

Any legal proceedings based hereon, or arising out of, under, or in connection with these Terms of Service, shall be brought and maintained exclusively in the courts of the Toronto, Ontario, Canada. The parties hereto hereby expressly and irrevocably submit to the exclusive jurisdiction of the courts of Toronto, Ontario, Canada for the purpose of any such legal proceedings as set forth above. The parties hereto hereby expressly and irrevocably waive, to the fullest extent permitted by law, any objection which they may now or hereafter have to the laying of venue of any such legal proceedings brought in any such court referred to above and any claim that any such legal proceeding has been brought in an inconvenient forum.

Modifications

These Terms of Service are effective from your first date of use of the Website for a period of one (1) year. Thereafter, these Terms will automatically renew for successive additional one-year terms upon the anniversary date, unless either party notifies the other party in writing of its intent not to renew or abide by these Terms of Service at least thirty (30) days prior to the end of the then-current term. We reserve the right to change these Terms of Service at any time in our sole, unfettered discretion and pursuant to applicable law. Amended versions of this Agreement will be effective upon posting on our website, and when such changes are deemed to be material by us, email notice of such amended version will be sent to Internet Traffic Owner. Your continued use of the Services after the effective date of any such changes will constitute your acceptance of and agreement to such changes. IF YOU DO NOT WISH TO BE BOUND TO ANY NEW TERMS, YOU MUST TERMINATE THESE TERMS OF SERVICE BY IMMEDIATELY CEASING USE OF THE SERVICES AND NOTIFYING US ACCORDINGLY. We agree to use commercially reasonable efforts to minimize unscheduled modification and maintenance interruptions.

No Third Party Beneficiaries. These Terms of Service are made solely for the benefit of the parties hereto and their respective successors and assigns, and no other person or entity shall have or acquire any right by virtue of these Terms of Service.

Waiver. No failure or delay by us in exercising any right, power or privilege hereunder shall operate as a waiver thereof nor shall any single or partial exercise thereof preclude any other or further exercise thereof or the exercise of any other right, power or privilege. The rights and remedies herein provided shall be cumulative and not exclusive of any rights or remedies provided by law.

Notice. Any notice, communication or statement relating to these Terms of Service shall be in writing and deemed effective: (i) upon delivery when delivered in person; (ii) upon transmission when delivered by verified facsimile or other confirmed electronic transmission; (iii) when delivered by certified mail, postage prepaid, return receipt requested or by nationally-recognized overnight courier service (including but not limited to Federal Express) to the address of the respective party as recorded herein in the case of us, and as submitted by you in the Registration Information when registering for the Website; (iv) in the event of non-material changes to this Agreement, notice shall be deemed effective upon posting at our Website; (v) and in the event of material changes to this Agreement, notice shall be effective upon the sending of an email to your recorded email address as set out in the Registration Information. Survival. All obligations herein which expressly or by their nature are to continue after termination, cancellation, or expiration of these Terms of Service shall survive and remain in effect after such happening.
